1. 我是否在 NLRA 的涵盖范围内?

美国劳工关系委员会 (NLRB) 的管辖权仅限于大多数私营部门雇主和美国邮政局;除美国邮政局雇员外,该委员会无权处理涉及《铁路劳动法》所涵盖的政府、铁路和航空公司雇主的劳资关系纠纷,也无权处理属于农业和家政劳工例外情况的雇员的劳资关系纠纷。 

2. 我的雇员没有加入工会,这种情况下 NLRA 是否仍适用?

是的。 大多数不由工会代表的雇员也享有 NLRA 下的权利。 具体而言,NLRA 保护雇员参与“受保护的协同活动”的权利,即两名或两名以上雇员就雇佣条款和条件采取互助或保护行动。 如果个别雇员在其他雇员的授权下行事,提请雇主注意集体投诉,试图发起集体行动或正在准备开展集体行动,或以本质上属于协同的方式行事,则他们可能也参与了受保护的协同活动。
