全國勞資關係法(NLRA)是否適用於我的企業?

1. 我是否在NLRA涵蓋範圍內?

國家勞資關係委員會(NLRB)的管轄範圍限於大多數私營部門僱主和美國郵政局;除美國郵政局僱員外,該委員會無權處理涉及《鐵路勞工法》所涵蓋的政府、鐵路和航空公司僱主的勞動關係糾紛,也無權管理屬於農業和家事勞工例外情況的僱員。 

2. 我的僱員沒有加入工會,NLRA是否適用?

適用。 大多數沒有工會代表的僱員也享有NLRA規定的權利。 具體而言,NLRA保護僱員參與「受保護的協同活動」的權利,即兩名或兩名以上僱員就僱傭條款和細則採取互助或保護行動。 如果個別僱員在其他僱員的授權下行事、將集體投訴提請僱主注意、試圖發起或尋求準備集體行動,或以本質上屬於協同的方式行事,則他們也可能參與了「受保護的協同活動」。
